The Madras High Court has permitted the release of Vijay's Kaavalan on certain conditions. It means the film will now surely release for Pongal 2011.
The producer Ramesh Babu and director of the film Siddique has to furnish a security of Rs 1.88 Crore, towards the suit claim filed by Sree Gokulam Chits and Finance company, claiming rights over the copyrights.
As per the petitioners, Johnny Sagarika Cinema Square, at Ernakulam had approached them for finance to completeBodyguard. Gokulam Chits had paid Rs 3.90 crore to Johnny Sagarika and copyrights, including rights of remaking, dubbing and world satellite rights, were given to them in January 2010.
Meanwhile Siddique and Ramesh Babu started the remake of Bodyguard asKaavalan in Tamil in violation of the copyrights assigned to Gokulam Chits.
Justice V Ramasubramanian in his order made it clear the balance amount due to repayment Rs 1.88 Crore has to be deposited in the court, byKaavalan producer and director which would take care of the interests of Gokulam Chits. By allowing the release of the film, it would take care of the interests of the producer
In his judgment Justice V Ramasubramanian said: "An order to direct the defendants to furnish security for the suit claim as a condition for the release of Kavalan would balance the interests of all the parties.†|
